These are the terms Xoda works to on every site visit, quote and maintenance call.
Read this before you request a site visit for control panel installation, HVAC controls maintenance or an emergency callout. It covers what we do, how pricing works, and what happens if something goes wrong.
When did these terms take effect?
These terms took effect on September 7, 2026, and that date applies to every site visit, quote and maintenance contract arranged after it. If we change them later, the version live on xodaqu.com at the time you request a visit is the one that governs that job.
Who exactly am I agreeing to these terms with?
Xodaqu, the registered company trading as Xoda at xodaqu.com. Our postal address is 114 River Road, Austin, Texas 57664, United States. That is the address we use for correspondence, for service of any legal notice, and for the crew's home base — we are not a national call centre routing your job to a subcontractor three states away.
You can reach us by phone at +1 (596) 555-8253 or by email at office@xodaqu.com for anything to do with these terms.
What does Xoda actually do, and what won't it do?
Xoda installs, commissions, repairs and maintains technical building and industrial equipment: control panels, HVAC controllers and rooftop units, access-control and security hardware, and the automation modules and sensors that tie them together. That work happens at your site — a plant room, a rooftop, a rack room — not in a shop, and not remotely except for the diagnostic monitoring we describe under Remote Monitoring on services.html.
We do not manufacture equipment, we do not sell hardware as a standalone retail transaction separate from an installation or repair job, and we will not rip out equipment that still works just to sell you new equipment. If a fix needs a part we don't stock, we say so on the phone before the technician drives out, not after.
Is anything sold on this website, and how does a job actually start?
No. Nothing on xodaqu.com is a store, a cart or a checkout, and no payment is taken through the site. Every form on this site — the site-visit request on contact.html, the request buttons on services.html and index.html — is an inquiry, not an order and not a binding quote.
A job starts like this: you submit the form or call us, we call back to scope the work, and if a figure is quoted over the phone or in writing at that stage it is an estimate based on what you've told us. The estimate becomes a binding price only after a technician has walked the site and you've accepted the written scope we send afterward. Nothing is charged before that acceptance.
How is a job priced, in what currency, and what makes the price change?
All pricing on Xoda's work is in US dollars. Each catalogue item on services.html states the basis it's priced on: installation and commissioning is quoted per site visit after a walkthrough; a preventive maintenance plan is billed per scheduled visit or as an annual contract; emergency repair is a dispatch fee plus an hourly rate quoted on the call; a retrofit or automation upgrade is quoted per project after a site survey; remote monitoring is billed monthly per monitored system.
A quoted figure changes if the scope changes once the technician opens the panel — a control loop that needs recalibrating beyond what was described, wiring that has to be replaced rather than reterminated, or a part that turns out to be discontinued and needs a substitute. We tell you before doing extra work that costs more, not after.
What am I not allowed to do with this site?
Don't submit a false name, address or equipment description on the inquiry form or in the chat widget to get a technician dispatched under false pretences. Don't use the site or the chat to send unlawful, threatening or abusive content, and don't attempt to probe, scan or overload submit.php, chat.php or any other part of the site's backend.
Don't scrape the site's pricing, copy or photographs for a competing directory or listing, and don't misrepresent yourself as Xoda or as one of our technicians to a third party. We reserve the right to refuse a request that violates any of this.
Who owns the words and photographs on this site?
Xoda owns the text, the photographs of our crew and vans and panel work, and the Xoda name and marks as they appear on xodaqu.com. You may view and share a page link, but you may not republish our photographs, copy our service descriptions into your own listing, or use the Xoda name or logo to imply an affiliation that doesn't exist.
What does Xoda not promise about this website?
The site itself — its content, its uptime, the chat widget — is provided as is. We don't warrant that xodaqu.com will be free of every error or interruption, and a price basis shown on services.html is descriptive, not a warranty that your specific job will land at that figure before the walkthrough happens.
What Xoda does warrant is the physical work, described in the next answer, and that warranty is separate from the website disclaimer above.
What happens if the installation or repair fails after the technician leaves?
Every commissioning job ends with a signed commissioning report, and every maintenance visit ends with a signed inspection sheet — not a shrug and a wave from the van. If equipment we installed or repaired fails because of workmanship within the period stated in that signed report, we come back and fix it at no additional labor charge for that specific fault.
That warranty does not cover a fault caused by equipment we didn't touch, by a power event, by someone else's work on the same system after our visit, or by a part that was already at end of life when we flagged it and you chose to defer replacement. We will tell you on the report when a part is marginal rather than pretend it's fine and let it fail on you six weeks later.
Is there a limit to what Xoda is liable for?
Yes. To the extent Texas law allows, Xoda's liability arising from a job or from use of this site is limited to the amount paid for the specific visit or contract giving rise to the claim. We are not liable for indirect or consequential loss — lost production time, spoiled stock in a cooler that failed, a tenant complaint — beyond that amount, except where the loss comes from our gross negligence, or where Texas law does not allow that limitation.
Can Xoda refuse to work with me or cut off access to the site?
Yes. We can decline or stop a job — before a deposit is taken, before a technician is dispatched, or between scheduled maintenance visits — if the site is unsafe to work in, if an invoice on a prior visit is unpaid, or if the acceptable-use terms above are broken. We can also restrict or withdraw access to the chat widget or the inquiry form from an address or account that's abused them.
Which state's law applies if there's a dispute?
These terms are governed by the law of Texas, United States, without regard to conflict-of-law rules. Any dispute that can't be settled by a phone call goes to the courts sitting in Austin, Texas.
How will I know if these terms change?
We update this page directly when the terms change and revise the effective date at the top of this document. We don't email every past customer about a wording change; the version live on xodaqu.com governs any job requested after the new date takes effect, and a job already under contract stays under the terms that applied when you accepted the scope.
Who do I actually write to about these terms?
Xoda, 114 River Road, Austin, Texas 57664, United States. Phone +1 (596) 555-8253, email office@xodaqu.com. For anything about how your information is handled rather than the terms themselves, see the privacy policy and its data-request section, and for the cookie and advertising detail behind this site, see the cookie policy.
